(춘천=연합뉴스) 박영서 기자 = 지적장애인에게 2천200여 차례에 걸쳐 외상으로 옷을 주는 대신 1억5천만원을 빼앗고, 소유한 주택과 토지까지 헐값에 사 거액의 재산상 이득을 챙긴 60대가 1심에 이어 항소심에서도 실형을 선고받았다.

춘천지법 형사1부(김대성 부장판사)는 준사기와 여신전문금융업법 위반 혐의로 기소된 A(66·여)씨가 낸 항소를 기각하고, 1심과 같은 징역 1년 10개월을 선고했다고 16일 밝혔다.

춘천에서 의류점을 운영하는 A씨는 2010년부터 7년여간 지적장애 3급인 B씨에게 2천200여 차례에 걸쳐 외상 옷을 팔아 1억5천만원 상당의 재산상 이익을 챙긴 혐의로 재판에 넘겨졌다.

A씨는 2010년 2월 중순 B씨에게 외상으로 옷을 판매한 일을 계기로 B씨와 알고 지냈다.

A씨는 B씨가 지적능력이 부족해 정상적인 거래나 계산을 하지 못하고 사리 분별이 깜깜한 데다 호감을 가진 사람의 말을 잘 거절하지 못한다는 점을 간파해 범행했다.

B씨가 직업도 안정적이고 퇴직도 얼마 남지 않아 퇴직금과 연금을 받을 수 있다는 점도 파악했다.

A씨는 B씨에게 외상으로 옷을 판매한 뒤 B씨 명의의 신용카드로 대출을 받거나 허위 매출을 발생 시켜 옷값을 치르게 했으며, 퇴직 후에는 B씨의 퇴직금이나 연금 등을 외상 대금으로 충당하게 한 것으로 드러났다.

또 B씨가 춘천에 주택과 토지를 소유한다는 사실을 알고는 2015년 11월 문맹인 B씨를 상대로 공시가격보다 낮은 금액으로 부동산의 소유권을 이전받아 3천850여만원의 재산상 이익을 챙겼다.

A씨는 재판에서 "B씨가 심신장애가 있지 않았고, 심신장애가 있었더라도 이를 인지하지 못했다"라고 항변했다.

또 외상거래에 따른 외상대금 채권을 발급한 점 등을 들어 여신전문금융업법 위반 혐의도 무죄라고 주장했다.

재판부는 "다시 한번 조사과정을 통해서 충분히 심리해본 결과 원심의 판단이 옳다는 결론을 내렸다"며 "피해자 측에서 처벌을 강하게 주장하는 점 등을 고려할 때 원심을 번복할만한 점이 인정되지 않는다"고 판시했다.
