e스포츠 '노예 계약' 막는다…문체부 표준계약서 밑그림

8월 2일까지 행정예고…게임단·선수·대가 등 정부 차원 정의 규정

일방적 계약해지 막고 청소년선수 인권 보장 의무화

(서울=연합뉴스) 이효석 기자 = e스포츠 선수와 프로 게임단 사이에 '노예 계약'이 체결되지 않도록 예방할 'e스포츠 표준계약서'의 밑그림이 공개됐다.

16일 게임업계에 따르면 문화체육관광부는 'e스포츠 선수 표준계약서(3종) 고시제정(안)'을 지난 13일 행정예고했다.

올해 5월 국회에서는 문체부가 e스포츠 표준계약서를 마련해 업계에 권장하도록 의무화하는 개정 'e스포츠 진흥에 관한 법률'이 통과됐다.

문체부는 이에 따라 공정거래위원회 등 관련 전문가 의견을 수렴해 표준계약서 고시 초안을 만들었다. 행정예고 기간은 총 20일로, 다음 달 2일까지다. 표준계약서는 개정 e스포츠진흥법과 함께 올해 9월 10일 시행된다.

문체부가 공개한 표준계약서 초안에는 e스포츠 선수와 게임단의 관계, 각자의 권리 및 의무, 후원금·상금 지급의 개괄적인 기준, 계약 해지 시 유의사항 등이 담겼다.

우선 표준계약서에는 '게임단'과 'e스포츠 선수'에 대한 정부 차원의 첫 정의가 명시됐다.

문체부는 게임단은 '종목사에서 주최하는 대회에 참가하기 위해 e스포츠 선수를 모집해 선수에게 각종 환경과 관리를 제공하는 주체', 선수는 '게임단에 소속되어 경기에 출전하는 주체'라고 정의했다.

표준계약서는 계약 기간에 대해서는 연월일을 모두 명시하고 며칠 간의 계약인지 구체적으로 적도록 규정했다.

그러면서 선수 활동의 대가는 '정기적으로 지급하는 후원금', '사전에 결정된 비율에 따라 분배하는 상금', '그 외 영리활동 등으로 얻는 수익 중에서 분배 대상으로 하기로 한 것' 등 세 가지로 규정했다.

표준계약서의 핵심은 게임단이 선수를 일방적으로 내쫓지 못하도록 예방하는 조항에 있다.

e스포츠계는 지난해 '그리핀 사건'으로 불리는 청소년 선수 부당 계약 폭로 사건으로 내홍을 겪은 바 있다. 당시 '리그 오브 레전드'(LoL·롤) 종목을 중심으로 게임단이 선수와 계약에서 사실상 전권을 행사하는 병폐가 드러났다.

문체부는 표준계약서에 '게임단 또는 선수가 계약상의 내용을 위반할 경우 상대방은 위반자에 대해 30일간의 유예기간을 정해 위반사항 시정을 먼저 요구하고, 시정되지 않는 경우 계약을 해제·해지할 수 있다'고 명시했다.

또 '계약상의 내용 위반이 없는 경우에도 상호 합의로 계약을 해지할 수 있다'는 내용도 담겼다.

게임단과 선수가 계약을 중도 해지하려면 상호 합의하도록 하고, 선수가 계약을 어기는 일이 있더라도 30일간의 시정 기간은 보장한 것이다.

표준계약서에는 게임단이 청소년 선수의 '신체적·정신적 건강, 학습권, 인격권, 수면권, 휴식권, 자유선택권 등 기본적인 인권'을 보장해야 한다는 내용도 포함됐다.

표준계약서가 게임단과 선수 양측에 금지한 행위도 눈길을 끈다.

게임단이 선수 의사에 반해 불필요한 비용을 선수에게 부담시키는 행위가 금지됐다. 게임단은 선수 교육·훈련에 드는 비용을 원칙적으로 부담해야 한다.

게임단은 상금이나 영리활동에 따른 금품을 선수에게 지급할 때 내용을 증빙할 수 있는 산정 자료를 함께 선수 측에 제공해야 한다.

선수의 경우 승부 조작, e스포츠 관련 도박, 대리게임, 이중 계약 등이 대표적인 금지 행위로 명시됐다.
