현대차 퇴직자들 "통상임금 합의금 달라" 집단소송

(울산=연합뉴스) 김근주 기자 = 현대자동차 퇴직자들이 통상임금 합의금(격려금)을 달라며 노사를 상대로 집단소송을 제기했다.

지난해 현대차 노사는 6년간 끌어오던 통상임금 소송을 대법원 판결 전 합의로 마무리했는데, 소송 진행 당시 재직하다가 퇴직한 직원들은 합의금 지급 대상에서 제외되자, 민사소송을 제기한 것이다.

현대차 정년퇴직자 통상임금 대책위원회는 23일 울산시청에서 기자회견을 열고 노사를 상대로 서울중앙지법에 손해배상 집단 소송을 제기했다고 밝혔다.

대책위는 "노조가 2013년 3월 통상임금 대표 소송을 시작하고 이듬해 단체협상에서 '소송 결과를 당시 재직자까지 포함한다'고 했으나 2019년 노사가 통상임금 소송을 마무리하면서 지급한 격려금을 퇴직자에겐 주지 지급하지 않았다"고 주장했다.

대책위는 "노사가 해당 격려금이 임금 경쟁력 확보를 위한 것으로 통상임금 소송과는 무관하다며 퇴직자를 제외했으나, 격려금 지급 조건에 임금 관련 소송 취하 조건을 단 것 자체가 모순이다"며 "통상임금 소송 관련 격려금이 분명한데 궤변을 한 것이다"고 지적했다.

대책위는 "평생 몸담았던 회사와 노조를 공동 피고로 하는 소송 자체가 이례적이어서 고심했다"며 "그러나 퇴직자들은 대표 소송 결과를 묵묵히 기다려온 피해자들이다"고 주장했다.

대책위는 "노사가 지금이라도 잘못을 인정하고 바로잡으면 재판까지 갈 필요가 없다"며 "결자해지를 촉구한다"고 밝혔다.

대책위는 통상임금 소송 후 지난해까지 퇴직자를 2천∼2천500명으로 추산했다.

이 가운데 837명이 이번 손해배상 소송에 동참했다.

대책위는 "손해배상 금액을 일단 1인당 100만원으로 정해 제기했으며 향후 금액을 보완할 것이다"고 밝혔다.
