집주인에게 많이 올려 주겠다고 한 임대료, 5%내로 낮출 수 있다

전세→월세 전환 때도 전월세전환율 준수해야

계약갱신청구권 행사는 계약 만료 1개월전…12월10일부턴 2개월 전

"집주인이 최근 계약을 연장해준다고 했지만 전세를 월세로 바꾸자고 했는데 월세가 너무 많은 것 같아요. 동의해야 할까요."

임대차 3법을 도입하는 주택임대차보호법(주임법) 개정안이 30일 국회 본회의를 통과해 조만간 시행될 예정인 가운데 제도와 관련한 궁금증이 커지고 있다.

중요한 것은 계약갱신청구권제가 신설돼 세입자에게 새로운 권리가 부여된다는 것이고, 전월세상한제는 이 계약갱신청구권에 따라오는 권리라는 것이다.

세입자는 집주인과 어떤 계약을 했건 상관없이 임대차 3법이 시행되고 나서는 한 번의 계약갱신청구권을 행사할 수 있으며, 이에 따라 전월세상한제도 적용받게 된다.

하지만 이미 집주인이 계약 연장 거부 의사를 밝히고 다른 세입자와 계약을 했거나 실거주하려는 매수인에게 집을 팔았다면 계약갱신청구권을 행사하기 어려워질 수 있다.

제도와 관련한 궁금증을 문답으로 풀이했다.

-- 계약 만료가 10월인데 집주인이 최근 계약을 연장해주면서 임대료를 15% 올릴 것을 요구해 이에 동의했다. 임대차 3법이 시행된 후 임대료 조정을 요구할 수 있나.

▲ 가능하다. 임대차 3법이 시행되고 나서 계약갱신청구권을 행사하면서 임대료 상승폭을 기존의 5% 이내로 맞춰달라고 요구할 수 있다.

하지만 집주인에게 임대료 상승분을 미리 줬다면 문제가 복잡해질 수 있다. 계약이 종결됐는데 돈을 '환수'하는 것을 뜻하는 것이기 때문이다.

-- 집주인이 계약을 연장해주기로 했지만 전세를 반전세로 전환하자고 했을 때는.

▲ 개정되는 주임법은 '갱신되는 임대차는 전 임대차와 동일한 조건으로 다시 계약된 것으로 본다. 다만 차임과 보증금은 법7조(전월세상한제) 범위 내에서 증감할 수 있다'고 돼 있다.

이에 따라 전세를 월세로 전환하려면 임차인 동의가 있어야 하고, 이 경우에도 법적으로 허용된 범위 내에서만 전환이 가능하다.

집주인과 세입자가 5% 인상에 동의했다고 했을 때 우선 전세보증금을 5% 올리고, 이를 다시 주임법상 '전월세전환율'을 적용해 보증금 수준에 맞는 월세를 산출해야 한다.

임대차 3법에 전세 매물 품귀 현상

전월세전환율은 전세 계약 기간 중 월세로 바꿀 때 그 전환 비율을 정한 것으로, '한국은행 기준금리+3.5%'로 돼 있다.

현재 기준금리가 0.5%이니 전월세전환율은 4.0%다.

예를 들어 보증금이 5억원인 전세의 계약을 갱신하면서 보증금 1억원에 월세로 전환한다고 하자.

집주인과 세입자는 5% 인상에 동의했다.

그러면 일단 보증금은 5억2천500만원으로 오른다.

여기에서 보증금 1억원을 제한 4억2천500원을 월세로 바꾸면 된다.

전월세전환율 4.0%를 적용하면 1천700만원이고, 이를 12로 나누면 월세 141만6천666원이 나온다.

집주인이 5억원 전세의 계약을 갱신하면서 보증금 1억원에 월세 200만원으로 바꾸자고 하면 월세는 인심 써서 141만7천원 정도만 주면 된다.

굳이 직접 계산할 필요 없이 국토교통부 등록민간임대주택 정보 사이트인 '렌트홈'에서 임대료인상률계산기를 쓰면 편리하다.

-- 집주인이 실거주를 이유로 계약갱신청구권을 거부했지만 이후 집을 매각했다. 이 경우 손해배상을 청구할 수 있나.

▲ 그렇지 않다. 다른 이에게 임대한 경우가 아니기 때문이다.

-- 계약갱신청구권은 계약 만료 1개월 전에 하면 되나.

▲ 일단 그렇다. 계약갱신청구권은 계약 만료 6개월~1개월 전에 하면 된다.

하지만 앞서 주임법이 개정돼 일부 내용이 12월 10일에 바뀌는데, 이때부터는 계약만료 1달이 아니라 2달 전에 계약갱신청구권을 행사해야 하는 만큼 각별히 주의해야 한다.

주임법에 새로 도입된 계약갱신청구권의 행사 기간은 묵시적 계약 연장을 거부할 수 있는 내용을 담은 제6조1항을 준용하게 돼 있는데, 이 조항에서 임대인이 묵시적 계약 연장을 거부하는 기간이 계약 만료 6개월~1개월 전으로 돼 있다. 하지만 12월 10일부터 6조1항에서 통보 기간이 6개월~1개월이 6개월~2개월로 바뀐다.

-- 계약갱신청구를 하려는데 집주인이 집을 다른 사람에게 판 경우 계약갱신청구권을 행사할 수 있나.

▲ 매수자가 실거주하는 것이 아니라면 가능하다. 매수자가 권리와 의무를 포괄승계 하기에 세입자는 새로운 집주인에게 계약 갱신을 요구할 수 있다.

하지만 매수자가 실거주 목적이고 법적 지위를 인정받는 경우 기존 세입자의 갱신 청구를 거절할 수 있다. 단, 새로운 집주인이 기존 세입자가 계약이 갱신됐다면 누릴 수 있었던 임대 기간(2년) 안에 다른 세입자를 들이면 전 세입자가 손해배상 소송을 제기할 수 있다.
