수원고법 1차 공판기일…"대법판결 '기속력' 있어 무죄 취지 판결 날 듯"

수원고법 형사2부(심담 부장판사)는 8월 31일 오후 2시 30분 수원법원종합청사 704호 법정에서 이 지사에 대한 파기환송심 1차 공판기일을 진행할 예정이라고 25일 밝혔다.

앞서 대법원 전원합의체는 지난 16일 이 지사에 대한 상고심에서 당선무효형에 해당하는 벌금 300만원을 선고한 원심을 파기하고 무죄 취지로 사건을 수원고법에 돌려보냈다.

대법원판결이 법적으로 기속력(羈束力ㆍ임의로 대법원 판결을 철회하거나 변경할 수 없는 구속력)이 있다는 점을 고려하면 앞으로 열릴 파기환송심에서도 상고심 판단이 그대로 받아들여질 가능성이 크다.

이 지사에 대한 재판은 1·2심을 거치며 수많은 증거가 제출됐고, 다수의 증인이 출석해 증언한 만큼, 새로 나올 증거나 증인이 더는 없어 이른 시일 내에 마무리될 것이란 관측도 제기된다.

법조계의 한 관계자는 "대법원이 파기환송한 사건이라 하더라도 앞으로 몇차례의 파기환송심 심리는 필요할 것으로 보인다"면서 "그러나 검찰이 새로운 증거나 증인을 신청하지 않는 이상 대법의 판결에 따라 허위사실유포 혐의는 무죄가 될 가능성이 높다"고 말했다.

내달부터 열릴 파기환송심을 끝으로 1심 무죄, 2심 유죄, 그리고 다시 3심의 무죄 판결이 내려진 이 지사 재판은 모두 마무리된다.

한편 이 지사는 성남시장 재임 시절인 2012년 6월 보건소장, 정신과 전문의 등에게 친형을 정신병원에 강제 입원시키도록 지시한 혐의(직권남용 권리행사방해)로 기소됐다.

그는 2018년 지방선거를 앞두고 열린 TV 토론회에서 '친형을 강제입원 시키려고 한 적이 없다'는 취지의 허위 발언을 한 혐의(공직선거법상 허위사실공표)도 받는다.

1심은 이 같은 혐의를 모두 무죄로 판단했지만, 2심은 허위사실공표 혐의에 대해서는 유죄로 보고 당선무효형인 벌금 300만원을 선고했다.

대법원은 그러나 "후보자 등이 토론회에 참여해 질문·답변하는 과정에서 한 말은 허위사실 공표 행위에 해당하지 않는다"며 무죄 취지로 사건을 수원고법에 되돌려 보냈다.
