(서울·세종=연합뉴스) 고유선 김수현 기자 = 교육부와 서울시교육청의 특성화중학교(국제중학교) 지정 취소로 내년에 일반중학교로 전환될 예정이던 대원·영훈국제중학교의 지위가 잠정적으로 유지된다.

대원국제중 관계자는 "법원이 29일 국제중 재지정 취소 처분에 대한 '잠정 집행 정지 결정'을 통보했다"며 "학교 측의 가처분 신청이 잠정적으로 인용된 것"이라고 30일 밝혔다.

잠정 집행 정지 결정 처분을 받음에 따라 교육부의 대원국제중·영훈국제중에 대한 특성화중 지정 취소 처분 효력은 당분간 상실된다. 법원은 잠정 집행 정지 결정 처분이 나온 지 한 달 이내에 최종결정을 내린다.

대원국제중 관계자는 "30일까지 내년 신입생 선발 공고를 내야 하는 학교 측 계획을 고려해 법원에서 이례적으로 잠정 결정을 내려준 것으로 보인다"고 말했다.

법원 결정에 따라 두 학교는 이날 오후 2021학년도 신입생 모집공고를 냈다.

다만, 실제 입학전형은 10월부터 진행되는 만큼 가처분 신청과 행정소송 결과에 따라 입학전형이 변경·취소될 가능성도 있다.

서울시교육청은 이번 판결이 마치 국제중 지정 취소가 중단된 것으로 인식하게 한다며 법원 결정에 유감이라는 뜻을 밝혔다.

서울시교육청은 "(두 학교에) 모집공고 시 행정소송 결과에 따라 입학전형이 변경, 취소될 수 있음을 안내하도록 했다"며 "법원이 가처분 결정 시에는 합법적인 절차에 의해 진행된 국제중 지정 취소 처분을 인정해 교육 정상화에 부응하기를 기대한다"고 덧붙였다.

앞서 서울시교육청은 의무교육인 중학교 단계에서 교육 서열화를 부추긴다는 이유로 지난달 10일 대원국제중과 영훈국제중의 특성화중 지정을 취소하겠다고 밝혔다. 서울시교육청의 특성화중 지정 취소 동의 요청을 받은 교육부는 이달 20일 두 학교의 지정 취소를 동의했다.

두 학교는 특성화중 지정 취소에 반발하며 법원에 지정 취소 처분 효력정지 가처분을 신청한 바 있다.
