"미 국토안보부 장관 임명절차 부적절"…트럼프 이민정책 발목?

회계감사원 "임명 규칙 수정 과정에 문제"…차관 대행도 부적합

(서울=연합뉴스) 현혜란 기자 = 도널드 트럼프 미국 행정부가 국토안보부 채드 울프 장관 직무대행과 켄 쿠치넬리 차관 직무대행을 임명하는 절차에 하자가 있었다며 이들에게 국토안보부를 이끌 정당성이 없다고 미국 회계감사원(GAO)이 14일(현지시간) 밝혔다.

미 의회의 회계감사 기구인 GAO는 상원 인준 없이 지난해 11월 국토안보부 수장이 된 울프 장관 대행과 쿠치넬리 차관 대행을 임명할 때 근거로 삼은 국토안보부 규정에서 오류가 발견됐다며 이같이 결론지었다고 AP, 로이터 통신 등이 전했다.

2017년 12월부터 국토안보부를 이끈 키어스천 닐슨 전 장관이 2019년 4월 물러날 때 임명에 관한 규정을 바꿨는데, 이때 행정명령을 수정하지 않고 행정명령 부속서류를 수정하면서 문제가 발생한 것이라고 미국 공영라디오 NPR는 지적했다.

닐슨 전 장관에 이어 국토안보부 장관 대행 자리에 오른 케빈 매컬리넌이 적법한 절차에 따라 임명되지 않았으므로, 그의 후임인 울프 장관 대행과 쿠치넬리 차관 대행 임명도 적법하지 않다는 취지다.

매컬리넌 장관 대행은 관련 규정에 문제가 있음을 확인하고 임기 중 규칙을 수정했지만, 소급적용을 할 수 없다는 게 GAO의 해석이다. 매컬리넌 장관 대행도 약 반년 만에 자리에서 물러났다.

GAO의 판단에는 법적 구속력이 없기 때문에 두 사람에게 즉각 영향을 미치지는 않을 전망이다. 다만, 국토안보부가 밀어붙인 이민·망명 정책을 문제 삼아 제기한 소송에서 법원이 트럼프 정부의 손을 들어주지 않을 근거가 될 수는 있다.

실제로 메릴랜드주 연방지방법원 폴라 시니스 판사는 이날 열린 난민신청자 취업허가 신청법 소송에서 GAO의 판단이 맞는다면 국토안보부의 규정을 무효화해야 한다고 밝혔다.

GAO는 국토안보부 감사관실에 이러한 내용을 담은 보고서를 전달했다.

트럼프 대통령은 집권 이래 정부 고위직 인사를 대행 체제로 운영하는 것을 선호해왔다. 의회의 반대에도 자신이 원하는 인사를 앉힐 수 있을 뿐만 아니라 시간을 절약할 수 있다는 이유에서다.

미 민주당은 GAO의 보고서를 근거로 즉각 문제를 제기했다. 민주당 척 슈머 상원 원내대표는 "트럼프 대통령이 극단적인 정책을 펼치기 위해 법과 상원을 무시해가며 정치적 아첨꾼들을 심으려고 한 노력이 막을 내렸다"고 비판했다.

하원 베니 톰슨(민주·미시시피) 국토안보위원장과 캐럴린 멀로니(민주·뉴욕 감독개혁위원장은 공동 성명을 내고 차드 장관 대행과 쿠치넬리 차관 대행의 사퇴를 촉구했다.

저드 디어 백악관 대변인은 GAO의 판단이 "잘못됐을 뿐만 아니라 우스운 일"이라고 비판했고, 국토안보부 대변인은 "근거 없는 GAO의 보고서에 전혀 동의하지 않는다"는 입장을 밝혔다.
