둔기 맞은 후배 9개월째 의식불명…가해 50대 항소심서 징역 7년

(전주=연합뉴스) 임채두 기자 = 고향 후배를 둔기로 수차례 내려쳐 의식불명에 빠뜨린 50대가 항소심에서도 중형을 선고받았다.

다만 재판부는 피고인에게 적용된 살인 미수 혐의를 인정하지 않고 예비적 공소사실인 특수중상해 혐의만 유죄로 판단했다.

광주고법 전주재판부 제1형사부(김성주 부장판사)는 A(52)씨에게 원심과 같은 징역 7년을 선고했다고 19일 밝혔다.

A씨는 지난해 11월 6일 0시 18분부터 오전 4시 24분 사이 고향 후배인 B(48)씨의 집에서 술을 마시던 중 B씨를 주먹과 둔기로 수차례 폭행한 혐의로 기소됐다.

B씨는 병원으로 옮겨졌으나 의식불명 상태에서 아직 깨어나지 못하고 있다.

경찰에 체포된 A씨는 "주먹으로 폭행한 사실은 있으나 둔기를 사용하지 않았다"고 혐의를 일부 부인했다.

검찰은 살인 미수 혐의로 A씨를 기소하고 예비적 공소사실로 특수중상해 혐의를 추가했다.

재판부는 "전기 주전자 열판에서 피해자의 유전자가 검출된 것으로 미뤄 피고인이 범행에 이것을 이용했다고 볼 수 있다"며 "피해자가 사망하지는 않았으나 피해를 본 이후 9개월째 의식불명이고 회복이 불가능할 것으로 보여 원심의 판단은 정당한 것으로 보인다"고 설명했다.

그러면서 "다만 피고인에게 살인을 저지를 동기가 없어 폭행에서 더 나아가 피해자를 죽이겠다는 마음마저 먹었다고 보기 어렵다"며 "또 피고인이 범행 직후 112와 119에 신고하고 구급대원의 지시에 따라 피해자의 상태를 알리고 조치한 점 등에 비춰보면 살인하려는 고의가 있었다는 합리적 의심이 들지 않는다"고 덧붙였다.
