1등 상금 6천원, 최대판돈 48만원 카드게임…도박일까 오락일까

1심 유죄, 2심 무죄…대법원, 상고 기각으로 무죄 확정

(서울=연합뉴스) 민경락 기자 = 1등을 할 때마다 다른 3명에게서 총 6천원을 받는 카드 게임. 현장에서 압수된 현금은 48만5천원. 이런 카드 게임이라면 도박일까 오락일까.

같은 장소에서 게임을 반복했다고 해도 상금 액수가 크지 않고 서로 친분이 있는 사람들이 잠시 즐긴 것이라면 도박죄로 처벌할 수 없다는 대법원 판단이 나왔다.

대법원 1부(주심 김선수 대법관)는 도박 혐의로 기소된 A씨 등 4명의 상고심에서 무죄로 판결한 원심을 확정했다고 18일 밝혔다.

이들은 2018년 12월 A씨가 운영하는 화원의 거실에서 함께 돈을 걸고 카드 게임을 한 혐의로 재판을 받아왔다.

게임은 1등에게 2∼4등이 차등적으로 돈을 몰아주는 방식으로 진행됐다. 2등은 1천원, 3등은 2천원, 4등은 3천원 등 1등이 다른 사람들로부터 게임마다 받는 총액은 6천원이었다.

주민 신고를 받고 출동한 경찰은 현장에서 48만5천원의 현금을 압수했다. 다만 이 돈이 모두 도박 대금으로 사용이 됐는지는 확인되지 않았다.

1심은 이들이 같은 해 2월부터 수차례 같은 장소에서 카드 게임을 해왔다는 주민 신고 내용, 판돈이 작은 규모로 볼 수 없는 점 등을 근거로 유죄로 판단했다.

그러면서 A씨 등 4명에게 각각 벌금 200만원을 선고했다.

그러나 판결은 2심에서 뒤집혔다.

재판부는 이들이 학창 시절부터 알고 지낸 친구 사이라는 점에서 카드 게임은 일시적인 오락의 성격이 있다고 판단했다.

확인된 게임 시간이 13분 정도로 짧았고 4명 모두 정기적인 소득이 있다는 점에서 비정상적인 상습도박으로 보기 어렵다고 봤다.

이 중 1명이 도박 혐의로 기소 유예 처분을 받은 적이 있지만 나머지 3명은 도박죄 처벌 전력이 없는 점도 고려됐다.

검사는 상고했지만 대법원은 원심 판단에 잘못이 없다며 상고를 기각했다.
