영국 법원 "시민권 박탈당한 'IS 신부' 입국 허용해야"

"공정하고 효과적으로 이의 제기하려면 영국 들어와야"

베굼, 2015년 IS 합류…영국 정부, 안보 이유로 시민권 박탈

(런던=연합뉴스) 박대한 특파원 = 이슬람 극단주의 무장단체 '이슬람국가'(IS)에 합류했다가 시민권을 박탈당한 이른바 'IS 신부' 샤미마 베굼(20)이 영국으로 다시 돌아올 수 있는 길이 열렸다.

16일(현지시간) 로이터 통신에 따르면 영국 항소법원은 자신의 시민권을 박탈한 영국 정부의 결정은 불법적이라며 베굼이 제기한 소송에서 "그녀가 공정하고 효과적으로 이의를 제기할 수 있는 유일한 방법은 영국 입국을 허용하는 것"이라고 밝혔다.

법원은 "이번 사건에서 공정과 정의가 국가 안보 우려보다 더 귀중하다"면서 "특별이민심판위원회(Special Immigration Appeals Commission) 결정에 대한 베굼의 사법 심사(judicial review) 요청을 받아들인다"고 판결했다.

사법 심사는 정부 결정이나 권력 행사의 적법성에 대해 이의를 제기할 수 있는 헌법적 권한의 일부다.

런던 출신인 베굼은 15살이던 2015년 2월 학교 친구 2명과 함께 시리아로 건너간 뒤 IS에 합류했고, 이후 네덜란드 출신 IS 조직원과 결혼했다.

베굼은 아이를 3명 낳았는데 먼저 낳은 2명은 질병과 영양실조로 목숨을 잃었고, 지난해 초 시리아 난민 캠프에서 출산한 셋째 아이도 출생 3주도 안 돼 폐렴으로 숨졌다.

베굼은 지난해 한 언론 인터뷰에서 시리아로 간 것을 후회하지 않는다고 밝혔고, 이에 당시 사지드 자비드 영국 내무장관은 안보 우려 등의 이유로 베굼의 시민권을 박탈했다.

베굼은 이에 이의를 제기했지만, 지난 2월 특별이민심판위원회는 정부 결정이 합법적이라고 판단했다.

국제법상 특정인의 시민권을 박탈하는 것은 그 사람이 다른 나라의 시민권을 가질 수 있을 때만 가능하다.

영국 시민권 박탈 당시 방글라데시계인 베굼은 방글라데시 시민권 자격 대상이었다.

그러나 방글라데시는 베굼이 자국과 무관하다고 밝혀, 베굼은 사실상 무국적 상태에 놓였다.

베굼의 변호인은 이같은 점과 함께 베굼이 영국으로 돌아오지 못하면 효과적으로 이의를 제기할 수 없다는 점을 강조했다.

이날 법원 판결이 내려지자 영국 내무부는 항소하겠다는 뜻을 나타냈다.

내무부는 "매우 실망스러운 판결"이라며 "정부의 우선사항은 국가안보를 유지하고 대중을 안전하게 보호하는 것"이라고 밝혔다.
