(서울=연합뉴스) 박형빈 기자 = 이명박 정부 시절 국가정보원과 공모해 김대중 전 대통령 뒷조사에 관여한 혐의로 재판에 넘겨진 박윤준 전 국세청 차장이 항소심에서도 무죄를 선고받았다.

서울고법 형사9부(한규현 권순열 송민경 부장판사)는 16일 특정범죄 가중처벌 등에 관한 법률 위반(국고 등 손실) 혐의로 기소된 박 전 차장에게 1심과 마찬가지로 무죄를 선고했다.

박 전 차장은 국세청 국제조세 관리관으로 근무하던 2010년∼2012년 초 이현동 당시 국세청 차장·청장의 지시를 받아 원세훈 전 국정원장 시절 국정원의 김 전 대통령 해외 비자금 의혹 뒷조사에 개입한 혐의로 기소됐다.

해외 정보원에게서 정보를 캐내기 위해 대북 공작에 써야 할 국정원 자금을 낭비한 혐의다.

1심 재판부는 "피고인은 원 전 청장과 이 전 청장의 지시에 의해 해외정보원에게 국정원 자금을 전달하는 데 관여하게 된 것에 불과하다"며 "피고인이 원 전 청장 등의 범행을 이용해 자신의 의도를 실현하거나 그들의 정치적 의도를 인지해 업무상 횡령을 했다고 볼 증거가 없다"고 판단했다.

또 박 전 차장이 수동적으로 사건에 연루됐고, 국정원 내부 의사 결정에 참여할 수 없는 지위에 있었다고 봤다.

재판부는 원 전 청장이 회계직원책임법상 회계처리자에 해당하지 않아 피고인이 공범이 될 수 없다는 박 전 차장 측의 주장도 받아들였다.

항소심 재판부는 이날 1심과 달리 원 전 원장이 회계 관계 직원이라는 점은 인정했으나, 박 전 차장이 그와 공모해 국고손실을 입힌다는 점을 알면서도 국정원 자금을 횡령했다고는 판단하지 않았다.

검찰은 항소심에서 박 전 차장에 대해 국고손실 방조 혐의와 업무상 횡령 방조 혐의를 예비적 공소사실로 추가했지만, 재판부는 이 역시 무죄로 판결했다.

한편 박 전 차장에게 국정원 협조를 지시한 이현동 전 국세청장도 같은 혐의로 기소됐지만 1·2심에서 모두 무죄를 선고받았다.
