서울남부지법 김진철 부장판사는 19일 김 씨의 구속 전 피의자 심문(영장실질심사)을 한 후 "증거를 인멸하거나 도망할 염려가 있다고 보기는 어려워 구속의 상당성 및 필요성이 부족하다"며 구속영장을 기각했다.

정씨는 지난 16일 오후 3시 19분께 국회의사당 본관 2층 현관 앞에서 제21대 국회 개원식에 참석해 연설을 마치고 나오는 문 대통령을 향해 신발을 벗어 던진 혐의(공무집행방해·건조물침입)로 현행범 체포됐다.
