검찰, 이혁진 전 대표 시절 투자 문제점 확인…정관계 로비 의혹도 수사 관측

(서울=연합뉴스) 성도현 기자 = 옵티머스자산운용의 초창기 펀드 투자 때부터 '펀드 사기'에 가담한 혐의를 받는 코스닥 상장 화장품 회사 임원이 22일 구속됐다.

서울중앙지법 최창훈 영장전담 부장판사는 이날 '스킨앤스킨' 신규사업부 총괄고문인 유모(39)씨의 구속 전 피의자 심문(영장실질심사)을 연 뒤 "혐의와 구속의 사유(증거인멸 염려) 및 그 필요성에 대한 소명이 갖추어져 있다"며 구속영장을 발부했다.

앞서 서울중앙지검 조사1부(오현철 부장검사)는 지난 20일 특정경제범죄 가중처벌법상 사기·횡령, 자본시장법상 부정거래, 사문서위조 등 혐의로 유씨의 구속영장을 청구했다.

검찰은 2017년 6월~2018년 3월 과학기술정보통신부(과기부) 산하 기관인 한국방송통신전파진흥원(전파진흥원)이 옵티머스에 748억원을 투자했다가 철회하는 과정에 유씨가 개입했다고 의심한다.

과기부는 2018년 감사에 착수해 전파진흥원의 규정 위반 사실을 적발하고 관련자 징계를 요구했다. 이에 전파진흥원은 투자를 철회했고, 같은 해 10월 검찰에 옵티머스 관계자들에 대한 수사를 의뢰했다.

검찰은 이날 옵티머스자산운용 김재현(50) 대표 등 현 경영진 4명을 기소하며 수사를 일단락했는데, 유씨 등에 대한 추가 수사로 이혁진(53) 전 대표 시절 투자 문제점까지 밝힐 수 있을지 주목된다.

이 전 대표는 전파진흥원이 대규모 투자를 시작한 한 달 뒤인 2017년 7월 사임했다. 전파진흥원의 마지막 투자 시점은 이 전 대표가 2018년 3월 해외로 출국한 무렵이다.

유씨는 옵티머스의 덴탈 마스크 유통 사업에도 깊숙이 개입된 것으로 전해졌다. 옵티머스는 지난달 스킨앤스킨으로부터 마스크 유통 사업 명목으로 150억원을 투자받았다. 이 자금은 김 대표 등이 펀드 환매 중단을 막는 용도로 사용했다는 의혹이 제기됐다.

스킨앤스킨이 선급금으로 150억원을 지급한 옵티머스 측 회사는 이피플러스다. 이피플러스는 옵티머스 이사 겸 H 법무법인 대표변호사인 윤모(43·구속기소)씨가 지분 100%를 보유하고 있다.

검찰조사 결과 특히 유씨는 지난 4~6월 펀드 환매 중단을 막는 과정에서 김 대표와 윤씨 등과 서류 위조를 공모한 것으로 드러났다. 검찰은 이들이 송금확인증을 위조해 스킨앤스킨에서 150억원을 받은 것으로 파악했다.

유씨는 옵티머스로부터 수백억 원의 펀드 자금을 투자받은 엔비캐피탈대부 대표이사, 골든코어·하이컨설팅 사내이사를 지냈다. 그의 아내 이모(35) 씨도 이들 회사에서 유씨와 같은 직책을 맡기도 했다.

특히 검찰이 최근 윤씨의 부인 이모(36) 변호사를 참고인 신분으로 소환하면서 정관계 로비 의혹 수사에도 나서는 게 아니냐는 관측도 나온다. 야권을 중심으로 한양대 인맥을 동원한 '권력형 비리' 의혹은 계속 제기돼 왔다.

이 변호사는 민주사회를 위한 변호사모임(민변) 출신으로 지난해 10월 청와대 민정비서관실 행정관으로 일하다 지난달 말 옵티머스에 대한 검찰의 압수수색 직후 사표를 냈다.

그는 김조원 청와대 민정수석이 2015년 새정치민주연합 당무감사원장 시절 당무감사원으로 일했다. 이광철 청와대 민정비서관과 함께 국가정보원 여직원 감금·안도현 시인 사건을 맡아 무죄를 끌어내는 등 여권과도 인연이 깊다.

이 변호사는 지난해 3~10월에는 옵티머스 계열사인 해덕파워웨이 사외이사로 근무했다. 해덕파워웨이는 옵티머스 펀드 자금으로 무자본 인수합병(M&A) 세력에 의해 경영권 인수가 됐다는 의혹을 받는 회사다.

검찰은 청와대 행정관 출신인 이 변호사가 옵티머스에 대한 금융당국의 부실 관리·감독과 관련해 영향을 미친 게 아닌지 등을 살피고 있다.
