편지 언급에 "한 건 걸리면 되지"…한동훈-기자 녹취록 공개(종합)

(서울=연합뉴스) 김계연 박재현 기자 = 이른바 '검언유착 의혹'으로 구속수감된 이동재(35) 전 채널A 기자 측이 지난 2월 한동훈(47·사법연수원 27기) 검사장과 나눈 대화 녹취록을 일부 공개했다.

이 기자 측은 녹취록을 근거로 유시민 노무현재단 이사장의 주가조작 연루 의혹을 제기하자고 한 검사장과 공모한 정황이 없으며 한 검사장이 취재를 독려한 사실도 없다고 주장했다.

◇ 유시민 얘기 꺼내자 "나는 전혀 모른다"

19일 이 기자의 변호인이 공개한 2월13일 대화 녹취록을 보면 한 검사장은 "제가 사실 교도소에 편지도 썼거든요"라는 이 기자의 말에 "그런 거 하다가 한 건 걸리면 되지"라고 답했다.

변호인은 이 기자의 구속영장 범죄사실에서 언급된 한 검사장의 발언은 이 부분이 거의 유일하다며 "한 건 걸리면 되지" 한 마디로 공모관계가 성립할 수 없다고 주장했다.

변호인은 "잘 해보라는 덕담이지 협박을 통해서라도 특정 정치인에 대한 제보를 강요하라고 한 것으로 해석할 수 없다"며 "이 기자가 편지를 언급한 부분은 오히려 한 검사장과 사전에 공모하지 않았다는 점을 강력히 반증한다"고 말했다.

이 기자와 동행한 백모 기자는 계속해서 "(이철 전 밸류인베스트코리아 대표가) 14.5년이면 출소하면 팔순이다", "가족부터 찾으려고 하고 있다"라며 취재 의사를 내비쳤다. 그러나 한 검사장은 별다른 대꾸 없이 기자들 숙소를 물은 뒤 자리를 정리했다.

변호인은 같은 날 이보다 앞선 대화 기록을 근거로 한 검사장이 유 이사장과 신라젠 의혹의 연관성에도 별다른 관심을 보이지 않았다고 주장했다.

한 검사장은 신라젠 의혹을 취재 중이라는 이 기자의 말에 "빨리 정확하게 수사를 해서 피해 확산을 막을 필요도 있는 거고"라며 서민 다중피해 사건이라는 취지로 말했다. 이 기자가 "많은 기자들도 유시민 언제 저기 될까 그 생각 많이 하는 것 같다"며 유 이사장 얘기를 꺼내자 "유시민씨가 어디에서 뭘 했는지 나는 전혀 모르니. 그런 정치인이라든가 그 사람 정치인도 아닌데 뭐"라고 답했다.

한 검사장은 유 이사장이 출국할 것 같다는 이 기자의 말에 "관심 없어. 그 사람 밑천 드러난 지 오래됐잖아. 그 1년 전 이맘때 쯤과 지금 유시민의 위상과 말의 무게를 비교해 봐"라고도 했다.

윤석열·한동훈 '말 없이 악수만'

◇ 녹취록 보도 역풍…KBS 명예훼손 피소

이 녹취록은 윤석열 검찰총장이 부산고검·지검을 방문한 지난 2월13일 당시 부산고검 차장검사로 있던 한 검사장의 사무실에서 세 사람이 나눈 대화를 백 기자가 녹음한 것이다. 서울중앙지검 형사1부(정진웅 부장검사)는 이 녹음파일을 이 기자와 한 검사장의 공모 혐의를 뒷받침할 물증으로 본다.

이 기자의 변호인은 녹취록에 유 이사장의 신라젠 연루 의혹을 제기하자고 공모한 정황이 담겼다는 전날 KBS 보도가 오보라며 녹취록 일부를 언론에 공개했다. 서울중앙지검 역시 해당 보도에 사실과 다른 부분이 많다며 선을 긋고 있다.

KBS는 한 검사장이 "'유 이사장은 정계 은퇴를 했다', '수사하더라도 정치적 부담이 크지 않다는 취지의 말을 했고 총선을 앞두고 보도 시점에 대한 이야기도 오간 것으로 확인됐다"고도 보도했다. 변호인은 이 역시 모두 사실과 다르며 보도 시점과 관련해 총선을 수 차례 언급한 건 이 기자가 아니라 이 전 대표의 대리인인 지모(55)씨라고 했다.

변호인은 "신병은 구속돼 있으나 인권에 대한 배려를 부탁드린다"며 KBS에 정정보도를 요청했다. 그러면서 "이 기자가 정치적 목적으로 검찰권을 동원한 것처럼 호도돼 있으나 공익적 목적의 취재 욕심을 부린 젊은 기자의 실수에 불과하다"며 "내일 오전까지 해당 기사를 정정하고 기사를 퍼나른 SNS 글을 삭제한다면 법적 조치는 취하지 않겠다"고 덧붙였다.

한 검사장은 이날 KBS 보도 관계자와 허위 수사정보를 KBS에 제공한 수사기관 관계자, 해당 기사를 유포한 사람들을 출판물에 의한 명예훼손 혐의로 수사해달라며 서울남부지검에 고소장을 냈다.

한 검사장은 "실제 존재하지도 않는 대화가 있었던 것처럼 꾸며낸 완전한 허구이며 창작에 불과하고, 보도시점이나 내용도 너무나 악의적"이라며 "당사자 확인없이 누구로부터 듣고 위와 같은 허위보도를 한 것인지 밝혀야 한다"고 주장했다.

법조계에서는 녹취록에 담긴 대화를 공모의 근거로 볼 수 있는지 검찰 내부에서도 견해가 극명하게 엇갈리는 만큼 전체 맥락을 따져봐야 한다는 지적이 나온다. 이 기자의 변호인은 오는 24일 대검찰청 검찰수사심의위원회에서 녹취록 전문을 놓고 공모 혐의가 없다는 반대증거임을 주장하겠다는 입장이다.
