(서울=연합뉴스) 박형빈 기자 = 신종 코로나바이러스 감염증(코로나19)의 유행으로 마스크 가격이 폭등하자 미포장 상태의 '벌크 마스크'를 불법 유통해 이득을 취한 일당에 벌금형이 선고됐다.

22일 법조계에 따르면 서울중앙지법 형사8단독 최창석 부장판사는 약사법위반 혐의로 기소된 A(43)·B(42)·C(44)씨에게 각각 벌금 3천만원을 선고했다.

A씨는 올해 2월 코로나19가 유행해 보건용 마스크의 가격이 폭등하자 마스크 유통업자로부터 의약외품의 명칭, 제조번호, 사용기한 등이 표시되지 않은 일명 '벌크' 상태의 보건용 마스크 10만장을 매입해 B씨와 C씨에게 1억3천만원을 받고 판매한 혐의를 받는다.

현행법은 의약외품을 판매하는 경우 약사법에서 정한 명칭, 제조업자 등 사항이 기재되지 않은 물품의 판매를 금지하고 있다.

B씨와 C씨는 A씨로부터 공급받은 벌크 마스크를 유통업자에게 1억7천만원에 판매한 혐의로 함께 기소됐다.

이들은 법정에서 자신들의 행위가 처벌 대상이 되는지 몰랐다고 항변했으나 재판부는 "그런 사정만으로는 처벌을 면할 수 없고 다만 양형 사유로서 참작하겠다"고 밝혔다.

재판부는 "피고인들의 행위는 전국적인 마스크 대란 상황을 틈타 경제적 이득을 얻을 요량으로 국민 건강에 위험을 초래하고 국민의 불안감을 가중한 행위로서 비난 가능성이 크다"고 지적했다.
