학대 발생한 가평 장애인시설서 전원조치 집행…반발·대치

보호자들 "일방적 탈시설은 또 다른 학대…섬세한 대책 마련돼야"

(가평=연합뉴스) 권숙희 기자 = 학대 사실이 드러나 폐쇄가 결정된 경기 가평군의 한 장애인 시설에서 무연고 장애인들에 대한 전원 조치가 13일 집행됐다.

이 과정에서 시설과 보호자 측은 "일방적 전원 조치는 또 다른 학대"라며 반발, 한때 대치했다.

경찰과 서울 금천구 등에 따르면 이날 오후 4시께 가평군의 한 장애인 시설에서 가족이 없는 무연고 장애인 9명에 대한 전원 조치가 이뤄졌다.

오전에는 시설 측의 주요 관계자들이 부재중인 상황에서 집행기관인 금천구 측과의 대치 상황이 이어졌다. 비상 상황에 대비해 경찰 인력도 동원돼 인근에서 대기했다.

전원 조치 집행은 오후 3시께부터 이뤄졌다.

금천구에 따르면 이들 9명은 다른 장애인 시설 5곳으로 나뉘어 옮겨진 뒤, 오는 9월 서울시의 '장애인 지원주택'으로 갈 예정이다.

가평 장애인 시설에는 보호자가 있는 장애인 약 40명도 거주 중인데, 이들의 보호자들이 시설 폐쇄 처분 등의 무효를 주장하는 소송을 진행 중이어서 이들에 대한 전원 조치는 이뤄지지 않았다.

이 시설 보호자연대의 관계자는 연합뉴스에 "장애인들이 충분한 시간을 갖고 준비를 해서 더 나은 시설로 가는 것이 아니어서 전원 조치로 굉장히 힘든 시간을 겪어야 한다"며 "이 과정에서 장애인들이 불안함과 두려움에 이상장세를 보이고, 장애인과 보호자들의 의견은 무시되고 있다"고 주장했다.

이 관계자는 또 "시설 자체에서 내부 자정 노력을 통해 인권침해 사건을 밝혀낸 것인데, 시설을 폐쇄하라는 조치는 받아들이기 힘들다"고 덧붙였다.

시설에서 거주 중인 중증 장애인 아들을 둔 한 여성도 "제대로 된 대안 없는 장애인들에 대한 일방적 탈시설 방침은 또 다른 학대"라며 "섬세한 대책이 필요하다"고 주장했다.

이에 대해 금천구 장애인복지팀 관계자는 "무연고 장애인의 보호자는 해당 기관 관할 구청장"이라면서 "그동안 정식 공문도 보냈고 몇 번 협의를 통해 연기 요청을 들어줬고, 이제 집행을 하게 된 것"이라고 설명했다.

앞서 서울시는 학대 사실이 드러나자 지난 3월 이 시설을 폐쇄하고 운영법인은 설립허가를 취소하는 절차를 지난 5월까지 마치겠다고 밝힌 바 있다.

이 시설에서는 앞서 국가인권위원회 조사 결과 종사자 7명이 시설 이용인 11명을 장기적, 반복적으로 폭행하고 학대한 사실이 확인됐다.

시설폐쇄 행정처분은 관할 자치구인 금천구가, 법인설립 허가 취소 행정명령은 서울시가 내리게 된다.

이 시설은 경기 가평군에 있지만, 운영 법인이 금천구에 있어 금천구가 행정처분 기관이다.
