재판부 "일부러 재판 지연시킨다는 오해 없도록" 지적

보복감금·상해·무고 등 7개 혐의…반성문 2차례·호소문 1차례 제출

(서울=연합뉴스) 김치연 기자 = 서울 강북구의 아파트 경비원 고(故) 최희석 씨를 폭행한 혐의로 재판에 넘겨진 주민 심모(49)씨의 첫 재판에서 변호인이 사임하면서 재판이 또다시 미뤄지게 됐다.

24일 서울북부지법 형사13부(혀경호 부장판사) 심리로 열린 심씨의 첫 공판에서 심씨 측 변호인은 검찰의 공소사실을 듣고 난 뒤 "제가 오늘 정식으로 사임하기로 해 새로운 변호인을 선임해 향후 절차를 진행하는 게 낫겠다"고 밝혔다.

재판부는 이에 "피고인이 6월 12일 기소됐고 두 달 구속기간이 8월 11일 1차 만료된다"며 "이달 3일 기일이 잡혔다가 17일 변경돼 오늘 열린 것인데 결국 3주 정도가 기일 변경 신청에 의해 지나간 것"이라고 지적했다.

재판부는 "구속사건이라 반드시 변호인이 있어야 하는 필수 변호 사건"이라며 "사임 후에는 법원에서 국선변호인을 선정해 진행하는 방향으로 할 수밖에 없다"고 말했다.

재판부는 "피고인이 일부러 재판을 지연시킨다는 오해를 하게 하는 일은 없는 게 좋다"며 "피고인에게 아무런 득이 되지 않는다"고 강조했다.

서울 강북구 우이동의 한 아파트 주민인 심씨는 올해 4월 21일 경비원 최씨와 주차 문제로 다툰 뒤 지속해서 최씨를 폭행하고 협박한 혐의를 받는다. 최씨는 심씨에게 폭행과 협박 등을 당했다는 유언을 남긴 뒤 5월 10일 스스로 목숨을 끊었다.

심씨의 공판은 지난 3일과 17일 2차례 심씨 측의 요청으로 기일이 변경됐다.

심씨는 지난달 30일과 이달 7일 반성문을 2차례 재판부에 제출하고 이달 22일에는 호소문을 제출한 것으로 확인됐다.

이날 재판은 최씨의 친형이 방청석에 앉아 지켜봤다.

그는 공소사실에 대한 피고인 측 인정 여부도 듣지 못한 채 재판이 끝난 뒤 "일부러 시간을 끄는 것 같다"며 "가족으로서는 피가 마르는 심정"이라고 말했다.

앞서 검찰은 심씨에게 특정범죄가중처벌법 위반(보복감금·상해·보복폭행)을 비롯해 무고, 강요미수, 협박, 상해 등 총 7개의 혐의를 적용해 기소했다.

다음 재판은 8월 21일 오전 10시 50분에 열린다.
