한동훈 "압수 대상은 휴대전화 아닌 유심…수색방해·거부 없어"

"변호인에게 전화하려 한 것을 증거인멸이라 주장…일방적 폭행당해"

(서울=연합뉴스) 박재현 기자 = 이른바 '검언유착 의혹' 수사팀의 압수수색 과정에서 발생한 몸싸움에 대해 한동훈(47·사법연수원 27기) 검사장이 재차 수사팀 측 주장을 반박하고 나섰다. 압수수색 대상물은 휴대전화가 아니라 유심(가입자 식별 모듈·USIM)이었으며, 변호인에게 전화하기 위해 휴대전화 잠금을 해제한 것이 증거 인멸 시도라는 것은 어불성설이라고 강조했다.

한 검사장은 29일 정 부장 입장문에 대한 반박 입장문에서 "압수수색을 방해하거나 거부한 사실이 전혀 없다"며 "(몸싸움이) 증거 인멸 시도를 막기 위한 것이라는 주장도 허황되다"고 말했다.

그는 "정 부장은 '휴대전화'가 압수수색 대상물이라고 했는데 이는 사실이 아니다"라며 '유심이 압수수색 대상물이라고 고지받았고, 영장에도 분명히 그렇게 기재돼 있었다"고 강조했다.

한 검사장의 설명대로 이날 검찰의 압수수색 대상은 한 검사장의 휴대전화 유심이었다. 수사팀은 이날 오전 한 검사장을 소환 조사하고 유심을 임의제출 받을 예정이었으나 한 검사장이 소환에 불응하면서 압수수색에 나섰다.

한 검사장은 "압수수색에서 변호인 참여권 행사를 위해 정 부장에게 '변호인 전화번호가 휴대전화에 저장되어 있으니, 이를 사용해 변호인에게 전화해도 되겠는지'를 문의했고, 정 부장은 명시적으로 허용했다"고 주장했다.

이어 "당연히 휴대전화는 먼저 잠금 해제를 해야 전화를 걸 수 있으므로 정 부장과 다른 검사들이 보는 앞에서 잠금 해제를 위해 비밀번호를 입력하고 있었는데, 갑자기 정 부장이 언성을 높이고 테이블을 넘어와 밀면서 휴대폰을 빼앗으려 했다"고 설명했다.

정 부장은 앞서 입장문에서 비밀번호를 입력하면 압수물 삭제 등 문제가 있을 것으로 판단해 한 검사장을 제지하고 나선 것이라고 주장했다. 압수수색을 방해하려는 행위가 있었고, 이를 막으려는 과정에서 물리적 접촉이 있었다고 했다.

당시 정 부장은 몸싸움을 벌이면서 '잠금 해제를 왜 페이스 아이디가 아닌 비밀번호 입력으로 하느냐'는 말을 했다고 한 검사장은 전했다. 페이스 아이디는 얼굴 정보를 카메라로 읽어 사용자를 인식하는 보안 수단이다.

한 검사장은 "내 휴대전화는 페이스 아이디가 아닌 비밀번호를 입력해 잠금 해제하도록 설정돼 있었다"며 "압수수색에 참여한 실무자들도 이를 확인했다"고 강조했다.

또 "수사 검사들이 다수 보는 상황에서 뭐든 지운다면 구속 사유가 될 텐데 그런 행동을 하겠나"라며 "피의자가 변호인에게 전화를 걸기 위해 잠금 해제를 시도한 것이 어떻게 증거인멸 시도 또는 압수수색 거부가 되나"라고 반문했다.

이어 "결국, 일방적으로 폭행당하면서 정 부장에게 휴대전화를 넘긴 것"이라며 "수사팀에서 당시 상황을 사실상 인정하는 장면과 일부가 한 검사장에게 개인적으로 죄송하다는 뜻을 표시하는 장면 등이 녹화돼있다"고 부연했다.

한 검사장은 정 부장을 독직폭행 혐의로 서울고검에 고소하고 감찰 요청했다. 고검은 정 부장에 대한 감찰 절차에 착수했다.

반면 정 부장은 한 검사장이 거짓 주장을 펼치고 있다며 무고 및 명예훼손 혐의로 고소하겠다고 밝혔다. 수사팀은 한 검사장에 대해 공무집행방해 등 추가 혐의 적용을 검토 중이다.
