검찰 '배출가스 조작 의혹' 닛산 본격 수사…고발인 조사

벤츠도 수사 진행 중…포르쉐는 시한부 기소중지

(서울=연합뉴스) 성도현 기자 = 경유차 배출가스 불법 조작 의혹을 수사하는 검찰이 닛산에 대해 본격적인 수사에 나섰다. 검찰은 23일 소비자단체를 상대로 첫 고발인 조사를 한다.

법조계에 따르면 서울중앙지검 형사5부(한윤경 부장검사)는 이날 오후 2시 박순장 소비자주권시민회의(소비자주권) 소비자법률센터 팀장을 고발인 신분으로 불러 고발 경위 등을 파악한다.

검찰은 이날 고발인 조사 내용을 토대로 닛산 일본 본사와 국내 법인 등에 대해 범죄 혐의를 적용할 수 있을지 여부를 검토할 방침이다. 관련자들도 피고발인 신분으로 부를 계획이다.

피고발인은 우치다 마코토 닛산 사장 겸 최고경영자(CEO)와 닛산 일본 법인, 허상중 한국닛산 사장과 한국닛산 법인 등 2명과 2개 법인이다. 닛산 측은 현재 검찰 수사에 대체로 협조하는 것으로 알려졌다.

소비자주권은 지난 5월 21일 메르세데스-벤츠, 닛산, 포르쉐 법인과 대표 12명을 대기환경보전법 위반·사기·위계공무집행방해 혐의로 수사해달라며 서울중앙지검에 고발했다.

이 단체는 당시 이들 3사가 배출가스 장치를 조작한 경유 차량을 판매해 수백∼수천억 원에 달하는 불법 이익을 얻었다면서 우리 제도와 법규를 무시하고 소비자를 우롱했다고 주장했다.

검찰은 벤츠 수사도 진행하고 있다. 지난 5월 27~28일과 6월 12일 벤츠코리아 본사 등을 압수수색 했다. 다만 디미트리스 실라키스 벤츠코리아 사장의 장기 해외 출장 등으로 수사 속도는 더딘 것으로 알려졌다.

포르쉐 수사는 현재 잠시 중단됐다. 검찰은 증거자료가 외국에 있는 점 등을 이유로 지난 16일 허버트 디에스 포르쉐 AG 사장과 법인, 크리스티안 네이터 포르쉐코리아 사장과 법인 등을 시한부 기소중지했다.

검찰은 독일에 국제 형사사법공조를 요청한 상태이며, 필요한 자료가 오면 수사를 재개할 방침이다. 기소중지는 피의자의 소재지 불명 등 사유로 수사를 종결할 수 없을 때 그 사유가 해소될 때까지 수사를 중지하는 조처다.

환경부는 지난 5월 초 벤츠, 닛산, 포르쉐가 2012~2018년 국내에 판매한 경유 차량 14종 총 4만381대에서 배출가스 불법 조작이 있었다고 판단해 인증 취소, 결함시정(리콜) 명령, 과징금 부과와 함께 검찰에 고발했다.

벤츠 등은 경유 모델에 질소산화물 환원 촉매(SCR)의 요소수 사용량을 줄이거나 배출가스 재순환 장치(EGR) 작동을 중단시키는 불법 프로그램을 사용해 배출가스를 조작한 것으로 조사됐다.

SCR 요소수 사용량이 줄어들거나 EGR 작동이 중단되면 미세먼지 원인 물질인 질소산화물이 과다 배출된다.

환경부는 이들 회사의 경유차가 주행 시 배출하는 질소산화물은 실내 인증 기준(0.08ｇ/㎞)의 최대 13배 이상에 달하는 것으로 파악했다.
