여성변회, '박원순 고소인' 조롱 논란 진혜원 검사 징계요청(종합)

"피해자 입장 고려하지 않은 경솔한 언사…국민에 대한 예의 저버려"

대검에 공문 형태 '징계심의 청구 촉구서' 우편 접수

(서울=연합뉴스) 성도현 박형빈 기자 = 고(故) 박원순 전 서울시장과 팔짱을 끼고 찍은 사진을 자신의 소셜네트워크서비스(SNS)에 올리고 "추행했다"고 말해 박 전 시장 고소인 조롱 논란을 일으킨 현직 검사에 대해 대검찰청이 징계에 나설지 관심이 쏠린다.

15일 법조계에 따르면 한국여성변호사회(윤석희 회장)는 이날 오전 진혜원(45·사법연수원 34기) 대구지검 부부장 검사의 징계 심의 청구를 촉구하는 A4 6장 분량의 공문을 우편으로 대검에 보냈다.

여성변회는 전날 오후 이 사안이 심각하다고 판단해 내부적으로 회의를 거쳤고, 대검 측에 징계를 요청하는 공문을 보내겠다는 뜻을 먼저 알린 것으로 전해졌다.

윤 회장은 이날 연합뉴스와 한 통화에서 "고인에 대한 애도를 부적절하게 표현했을 수 있다"면서도 "공무원으로서 피해자를 조롱하거나 여론재판이라고 호도해서는 안 된다고 보고 징계를 요구한 것"이라고 말했다.

이어 "진 검사가 피해자에게 온당치 않은 방식으로 2차 가해를 하고 있다"며 "성 인지 감수성이 어느 정도인지 굉장히 의문스럽다. 공직자로서의 부적절한 행위에 대해 대검의 엄중한 판단을 촉구한다"고 덧붙였다.

연합뉴스가 입수한 공문에 따르면 여성변회는 "진 검사는 공무원으로서 지켜야 할 공정하고 진중한 자세를 철저히 망각했다"며 "피해자의 입장을 전혀 고려하지 않은 채 경솔하고 경박한 언사를 공연히 SNS에 게재함으로써, 검찰 전체에 대한 국민의 신뢰를 실추시키며 국민에 대한 예의를 저버렸다"고 밝혔다.

또 검사에 대한 징계 사유를 밝힌 대법원판결을 인용해 "검사로 하여금 직무와 관련된 부분은 물론 사적인 언행에 있어서도 신중을 기하도록 하고 있다"고 비판했다.

여성변회는 "명백히 검사징계법 제2조 제3호의 검사징계 사유인 '검사로서의 체면이나 위신을 손상하는 행위'에 해당한다"며 "검사징계법 제7조 제2항에 의거하여 윤석열 검찰총장이 진 검사에 대해 검사징계위원회에 징계심의 청구를 할 것을 강력히 요청한다"고 말했다.

대검 감찰부(한동수 감찰부장)는 공문이 도착하면 내용을 검토한 뒤 감찰에 착수할지 결정할 방침이다. 관련 규정에 따라 대검 감찰3과가 사건을 직접 담당하거나 대구고검 또는 대구지검으로 이첩할 수도 있다.

검사징계법상 감찰 담당 부서가 결과를 윤 총장에게 보고하고 징계의 필요성이 있다고 판단되면 윤 총장은 징계를 청구할 수 있다. 이후 법무부 장관이 검사징계위원회를 소집해 최종적으로 수위를 결정한다. 징계 종류는 해임과 면직, 정직, 감봉, 견책이 있다.

앞서 진 검사는 박 전 시장 발인일인 지난 13일 자신의 페이스북에 "자수한다. 팔짱을 끼는 방법으로 성인 남성 두 분을 동시에 추행했다"는 글과 함께 박 전 시장과 찍은 사진을 올려 피해자 조롱 논란이 일었다.

진 검사는 "페미니스트인 제가 추행했다고 말했으니 추행"이라며 "권력형 다중 성범죄"라고 주장했다.

또 피해자를 향해 "현 상태에서 본인이 주장하는 내용 관련 실체 진실을 확인받는 방법은 여론 재판이 아니다"라며 "유족을 상대로 민사소송을 해서 판결문을 공개하는 것"이라고 덧붙였다.

아울러 "고소장 접수 사실을 언론에 알리고, 고인의 발인일에 (피해자 측에서) 기자회견을 하고, 선정적 증거가 있다고 암시하면서 2차 회견을 또 열겠다고 예고하는 등 넷플릭스 드라마 같은 시리즈물로 만들어 '흥행몰이'와 '여론재판'으로 진행하면서도 그에 따른 책임은 부담하지 않겠다는 태도를 보인다"라고도 적었다.

진 검사는 이후 올린 또 다른 글에서는 안희정 전 충남도지사를 언급하며 "(여성이) 남성 상사와 진정으로 사랑해도 성폭력 피해자일 뿐 '사랑하는 사이'가 될 수 없는 성적 자기 결정 무능력자가 되는 것"이라고 말했다.

그러면서 "마이크로소프트사 창업자인 빌 게이츠는 자기 비서였던 멜린다와 연애하고 나서 결혼했다"며 "(안 전 지사의 유죄를 인정한 대법원 판결문에 따르면) 빌 게이츠를 성범죄자로 만들어 버린다"라고도 주장했다.

진 검사는 이날 새벽 페이스북에 올린 글에서는 그리스 비극 '히폴리토스'를 언급했다. 이 글에는 박 전 시장의 결백을 주장하며 피해자의 태도를 비판하는 듯한 느낌이 담겼다.

그리스의 영웅 테세우스의 아들인 히폴리토스가 새어머니인 파이드라의 유혹을 거부하자, 파이드라는 거짓 유서를 쓰고 자살한다. 테세우스는 신들에게 아들의 죽음을 탄원하고, 히폴리토스는 방황하다가 죽는 내용이다.

진 검사는 "사실관계는 프레임을 짜고 물량 공세를 동원한 전격전으로 달려든다고 확정되는 것이 아니다"라며 "이성과 논리로 증거를 분석하는 절차를 거쳐 확정되는 것"이라고 말했다.
