현실화된 임대차 3법…미국·독일·프랑스엔 유사 제도 시행중

(세종=연합뉴스) 윤종석 기자 = 임대차 3법이 국회에서 속전속결로 처리됨에 따라 임대차 시장에 큰 변화가 불가피할 전망이다.

이제 세입자는 기존 2년의 계약 기간이 지나도 한번 계약을 연장할 수 있게 된다. 이때 집주인은 임대료를 직전의 5% 이상 올리지 못한다.

집주인이 자신이 실거주하겠다며 계약갱신을 거절한 경우 원래 계약이 연장됐다면 유지됐을 기간 내 다른 세입자를 받았다간 전 세입자로부터 손해배상청구 소송을 당할 수 있다.

일각에서는 집주인에 대한 과도한 사유재산 침해라는 반발도 나온다.

하지만 국회 법사위의 주택임대차보호법 개정안에 대한 검토보고서를 보면 계약갱신청구권과 전월세상한제와 같은 제도는 다른 선진국에선 널리 운용되고 있다.

독일은 특별한 사유가 없는 한 임대차 기간을 정하지 않은 계약이 원칙이다.

임대인이 계약을 해지하려면 본인의 실거주 등 정당한 사유가 있어야 하고 이 때에도 계약 해지가 임차인에게 너무 가혹한 경우에는 임차인이 이의를 제기해 임대차 관계를 유지할 수 있다.

임대료 인상은 사전에 미리 정한 기간 일정 금액을 단계적으로 인상하는 계단이나 연방통계청의 가계물가지수에 맞게 인상하는 지수식 등을 통해 약정하는 방식으로 운용된다.

집주인은 임차인과 합의 없이도 비교임대료에 맞춰 차임 인상을 요구할 수 있지만 임대료는 한번 책정되면 15개월이 지난 후 인상할 수 있고 3년 내 인상률이 20%(임대차 수요가 큰 곳은 15%)를 넘기지 못한다.

비교임대료는 임대차계약을 체결한 지역에서 해당 주택과 비슷한 종류, 크기, 입지를 갖춘 주택에 대해 과거 4년간 형성된 일반적인 임대료다.

프랑스도 개인은 3년, 법인은 6년의 최단 임대차 기간을 보장하고, 계약 기간이 끝날 때 임대인에게 정당한 사유가 있는 경우에만 계약해지가 가능하도록 하고 있다.

차임을 올릴 때 국가통계경제연구원이 발표하는 '비교기준 임대료지수'(IRL)의 변동폭을 넘지 못한다. IRL은 소비자물가지수의 변동 등을 반영해 산정된다.

미국의 뉴욕주는 임대차 계약갱신을 원칙으로 하고 세입자가 집주인에게 임대료를 계속 지급하는 한 집주인의 실거주 등 사유를 제외하고는 계약갱신을 거절하거나 강제 퇴거시킬 수 없도록 한다.

주거용 빌딩의 경우 임대료위원회가 최대기본임대료(Maximum Base Rent: MBR)를 2년 단위로 고시하는데, 최대 인상률은 7.5%다.

로스앤젤레스나 샌프란시스코도 뉴욕과 마찬가지로 기한이 없는 임대차가 원칙이고 법정 사유가 있어야 계약 갱신 거절이 가능하고 행정기관의 승인도 필요하다.

이웃나라 일본에서도 집주인이 계약 해약을 신청할 때 6개월의 유예기간을 두고 정당한 사유가 있다면 임대차가 종료되도록 하고 있다.

일본은 임대료 증액 청구 시 약정한 차임 등의 5%를 초과하지 못하도록 규정하고 있다.

이에 반해 영국은 과거 계약갱신청구권제나 전월세상한제 제도를 운영했으나 지금으로선 대부분 제도를 폐지한 것으로 파악된다.

현재 단기보장임대차제도가 보편적인 형태인데, 집주인이 2개월 전 사전 통지만 하면 아무런 사유 없이 주택의 인도를 요구할 수 있다.

임대료 증액과 관련해서도 별다른 규제가 없다.
