정의연 "참고인 조사 불응하자 입건…검찰, 수사준칙 위반"(종합2보)

"죄명·피의사실 고지하지 않고 전직 활동가에 출석 통보…인권침해"

서울서부지검 "위법·부당한 내용 없어…적법 절차에 따른 것"

(서울=연합뉴스) 김주환 기자 = 참고인 소환 통보를 받은 전직 활동가가 조사에 즉시 응하지 않자 검찰이 죄명을 고지하지 않고 피의자로 입건했다며 정의기억연대(정의연)가 인권침해 중단을 촉구했다.

17일 법조계 등에 따르면 회계부정 의혹으로 수사를 받는 정의연의 변호인은 지난 15일 서울서부지검 인권감독관실에 검찰이 강압적 방법으로 참고인 출석을 강요하고 있다며 이러한 내용의 신고서를 제출했다.

신고서에 따르면 정의연 전신인 한국정신대문제대책협의회(정대협)에서 활동했던 A씨는 13일 서울서부지검으로부터 '2014년 정대협 일본군 위안부 피해자 치료사업 관련해 문의 사항이 있으니 연락해달라'는 문자를 받았다.

A씨는 검찰에 전화를 걸어 "6년 전 일했던 내용에 대해 기억이 나지 않고, 2015년 2월 퇴사했다"며 "지금은 제주도에 살아 출석하기 어렵다"고 말했다.

전화를 받은 서울서부지검 형사1부(이병석 부장검사) 검사실 소속 수사관은 "2014년 일본군위안부 피해자 치료사업 담당자로 이름이 보이길래 전화했다. 나중에 문의 사항이 생기면 전화할 테니 연락을 받아달라"고 답했다.

다음날 해당 검사실 소속 수사관은 재차 연락해 "배려해서 제주지검으로 내려갈 테니 16일 오전 10시까지 오라"고 했고 A씨는 "오래전이라 기억나는 것도 없고 말할 것도 없어 가고 싶지 않다"고 거부했다.

수사관은 A씨의 말에 "그럼 번거롭게 소환장과 체포영장이 발부돼 여러 사람이 가게 될 것이고 (A씨가) 서울로 올라와야 한다. 말하기 싫으면 제주지검에 와서 '기억이 안 나 진술을 거부한다'고만 말하고 가라"고 했다.

A씨 측은 신고서에서 "(수사관이) 격앙된 큰 목소리로 말해 무섭고 겁이 났다"며 "예전에 정대협에서 같이 일했던 언니나 변호사에게 좀 여쭤보겠다고 하고 전화를 끊었다"고 밝혔다.

A씨는 다시 검찰에 연락해 "왜 소환장과 체포영장을 말해 협박하는 것이냐. 아는 변호사님께 알아봤더니 피의자가 될 가능성도 없다고 한다"고 항의했다. 수사관은 "피의자가 될지 말지는 우리가 판단한다"고 답했다.

이런 대화가 있던 당일 오후 늦게 휴대전화를 확인한 A씨는 검찰에서 '피의자로 입건되었다. 16일 오전 10시까지 제주지검으로 출석해 달라'는 문자가 온 것을 확인했다.

마지막으로 수사관과 통화한 지 4시간여만이었다.

검찰은 이후 A씨에게 보낸 문자에서 '제주지검을 포함한 검찰청에 일절 출석하지 않겠다는 의사를 표시한 후 검찰청의 문자 및 전화에 일절 답하지 않고 있는바, 소환 요청에 답변조차 하지 않을 경우 출석 불응에 따른 법적 절차가 진행될 수 있다'고 안내했다.

A씨는 "너무 겁이 나서 어찌해야 할지 몰라 발만 동동 구르고 있었다. 식사도 제대로 할 수 없었고 밤에 잠도 자기 어려웠다"고 신고서에서 밝혔다.

정의연 측 변호인은 검찰의 행위가 인권침해라고 주장했다.

변호인은 "검찰은 참고인 신분인 A씨를 피의사실은 물론이고 죄명조차도 고지하지 않은 채 피의자로 입건했고, 일방적으로 일정과 장소를 정해 출석하라고 했다"며 "참고인으로 당장 조사받기 어렵다고 하자 출석 조사를 받도록 할 목적으로 겁박해 입건한 것으로 볼 수밖에 없다"고 말했다.

이어 "인권보호 수사 준칙에서 규정한 '참고인에 대한 강압적인 언사 등에 의한 출석 강요 금지' 규정을 위배한 것"이라며 "내사 또는 진정 사건으로 수리해 신속·공평하게 처리해 달라"고 인권감독관실에 요청했다.

변호인 측은 신고서를 제출하면서 검찰수사심의위위원회를 열어 A씨에 대한 수사 진행 여부를 판단해 달라고 요청했다.

그러나 변호인 신청으로 17일 열린 부의심의위원회에서는 해당 사건을 검찰수사심의위에 부의하지 않기로 결정했다.

서울서부지검은 "사건 관계인의 출석조사 요구와 관련해 위법하거나 부당한 사항이 없었다"며 "조사 대상자가 변호사와 상의 후 갑자기 출석하지 않겠다면서 검사실의 전화 등 연락에 일절 응하지 않았다"고 밝혔다.

이어 "증거관계 등을 고려해 적법 절차에 따라 대상자를 입건하고 재차 출석 요구 연락을 했으나 대상자 측에서 이에 대해서도 응하지 않는 상황"이라고 덧붙였다.
