학부모에게서 '후원금' 1억원 받은 대학 축구부 감독 벌금형

금품 건넨 학부모도 벌금 400만원…2천만원 받은 코치는 선고유예

(서울=연합뉴스) 김주환 기자 = 서울서부지법 형사7단독 유창훈 판사는 학부모회 회장으로부터 1년여간 후원금 명목으로 1억여원을 받은 혐의(부정청탁 및 금품 등 수수의 금지에 관한 법률 위반)로 기소된 지방 사립대 축구부 전 감독 김모(55)씨에게 벌금 500만원을 선고하고 1억여원을 추징했다고 21일 밝혔다.

재판부는 김씨에게 금품을 건넨 학부모회 회장 A(53)에게도 벌금 400만원을 선고했다.

김씨는 2016년 9월부터 2018년 2월까지 축구부 감독으로 재직하면서 A씨 등으로부터 총 18회에 걸쳐 후원금 명목으로 1억275만원을 받아 챙긴 혐의로 재판에 넘겨졌다.

김씨 측은 재판에서 자신이 청탁금지법 적용 대상이 아닌 기간제 근로자에 해당하며, 학부모 후원회와의 약정에 따라 별개로 보수를 받기로 했다고 주장했다.

그러나 재판부는 "사립학교 교원도 청탁금지법 적용 대상에 포함되고 학부모후원회 규약에 따른 금품 제공은 구성원들 내부에서 자율적으로 이뤄지는 것일 뿐 피고인이 이를 요구할 정당한 법률적 근거가 없다"며 주장을 받아들이지 않았다.

재판부는 김씨와 A씨에 대해 "오간 금품의 규모가 상당히 큰 점을 고려할 때 선고유예 사안으로 보긴 어렵다"면서도 "수수액 중 절반가량을 반환한 점, 비교적 오래전의 벌금형 처벌 전력만 있는 점, 반성하는 점 등을 참작했다"고 밝혔다.

비슷한 시기에 A씨 등으로부터 2천900여만원을 받은 혐의로 김씨와 함께 기소된 코치 조모(39)씨는 선고유예 처분을 받았다.

재판부는 "감독의 지시를 받던 상황에 비추어 참작할 바가 있는 점, 수수액을 전부 반환한 점, 이 사건으로 입을 수 있는 직업상 불이익을 참작할 필요가 있다"고 양형 이유를 밝혔다.
